We collect Personal Information from you and any devices (including mobile devices) you use when you use the Site. This Privacy Policy does not apply to the practices of third parties that we do not own or control, including but not limited to any third party websites, services and applications that are linked or made available on our Site (“Third Party Services”). While we attempt to facilitate access only to those Third Party Services that share our respect for your privacy, we do not take responsibility for the content, actions, or privacy policies of those Third Party Services. The Information We Collect.

We collect Personal Information from you and any devices (including mobile devices) you use when you: use our Site, provide us information on a web form, or when you otherwise correspond or connect with us. Sharing Your Information.

We share non-Personal Information with third parties at our discretion. We do not transfer your information to third parties in exchange for money, and we will not do so.  However, we do share Personal Information with certain third parties in order to operate our business (for example, to market our products and services, including to personalize advertising that is targeted to you). Additionally, we will share your Personal Information with third parties (i) where required by applicable law, regulation, legal process or governmental request, (ii) where it is necessary in connection with our services or products, (iii) to investigate or prevent fraud, abusive or unlawful uses or activities, violations of the terms governing use of the Site and services and/or any law, rule or regulation, and/or (iv) to protect the security or integrity of the Site and services or to protect our rights, property, or safety or to protect our users and the public. This includes exchanging information with other companies and organizations for fraud protection and spam/malware prevention.

Information Disclosed in the Event of a Business Transfer. If we are subject to a merger or acquisition with/by another company, we may share information with the other company in connection with the transaction, and your Personal Information may be transferred to such company upon completion of the transaction. Such acquiring company’s right to use your Personal Information shall be limited to the terms of this Privacy Policy unless additional notice is provided to you.

International Transfer of Personal Information. Most of the third parties with whom we may share your personal information are located and store your information in the United States, although some may store your information outside of the United States, the laws of which may differ than those governing your personal information in your country. If you are located in the European Union or the United Kingdom, and to the extent the data protection laws in such country are deemed by your country to have inadequate data protection, we have put in place certain measures to ensure that your personal information is subject to suitable safeguards in such transfer outside the European Union or the United Kingdom.

Aggregate Information. We may share aggregated and de-identified information (“Aggregate Information”) with our partners, service providers and other persons with whom we conduct business. We may share this type of statistical data so that our partners can understand how and how often people use our Services and their services or websites, which facilitates improving both their services and how our Services interface with them. In addition, these third parties may share with us de-identified, aggregated or otherwise non-Personal Information about you that they have independently developed or acquired.

How We Safeguard Your Personal Information.

The security of your data is important to us but remember that no method of transmission over the Internet or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your Personal Information, we cannot guarantee its absolute security. Any transmission of Personal Information is at your own risk.

Your Rights and Options Regarding Your Personal Information.

Marketing Preferences. By providing your telephone number and/or email address to us, you consent to receive text messages and/or emails from or on behalf of us and/or our partners and suppliers. If you would like to opt out of marketing-related email or text message communications from us, you can use the unsubscribe link found at the bottom of the email to opt out of receiving future marketing emails, by replying “STOP” if you receive Coyote SMS communications, or by contacting us as set forth in this Privacy Policy. Please allow sufficient time for your preferences to be processed. Even if you opt out of receiving marketing messages, we may still contact you for transactional purposes like confirming or following up on an order or service request, asking you to review a product or service you have ordered, or notifying you of product recalls. If you later opt back into getting marketing communications from us, we will remove your information from our opt-out databases.

Cookies. As noted above in “The Information We Collect” above, you can choose whether to accept cookies by changing the settings on your browser or device. However, if you choose to disable cookies, your experience with the Site may be impaired and some features may not work as they were intended.

Additionally, Do Not Track is a preference you can set in your web browser to inform websites that you do not want to be tracked. You can enable or disable Do Not Track by visiting the preferences or settings page of your web browser. However, these features are not yet uniform, so we do not currently respond to such features or signals. Therefore, if you select or turn on a “do not track” feature in your web browser, we and our third-party providers may continue collecting information about your online activities as described in this Privacy Policy.

State- or Country-Specific Rights.

Depending on where you live, you may have certain rights with respect to Personal Information that we have collected and used under certain circumstances, which may include the following rights:*

  • The right to request correction of your inaccurate Personal Information.

  • The right to opt out of sales or sharing of your Personal Information.  Coyote does not sell your Personal Information. Like most websites, our Site uses cookies and other technologies to interact with third parties and service providers for things like website analytics and advertising. Some of this website interaction with third parties may be viewed as a “sale” under the CCPA, which defines “sale” very broadly. Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your Personal Information. Please understand that we are required to verify your request and may require you to provide some information to enable us to carry out such verification. We cannot respond to your request or provide you with Personal Information if we cannot verify your identity or authority to make the request and confirm the Personal Information relates to you.

Making a verifiable consumer request does not require you to create an account with us. We will only use Personal Information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

Transfer of Data; Special Notice to Non-U.S. Users.

Your information, including Personal Information, may be transferred to, and maintained on, computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ from those of your jurisdiction. If you are located outside United States and choose to provide information to us, please note that we transfer the data, including Personal Information, to the United States and process it there. Your consent to this Privacy Policy followed by your submission of such information represents your agreement to such transfer.

We will take all the steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy and that no transfer of your Personal Information will take place to an organization or a country unless there are adequate controls in place including the security of your data and other Personal Information.

Children’s Information.

The Site are not intended for use by children under the age of 13 (“Children” or “Child”). By using the Site, you represent that you are at least 13. If you do not meet this age requirement, please do not access or use the Site. We do not knowingly collect personally identifiable information from Children, and we do not target the Site to Children. If we become aware that we have collected Personal Information from Children without verification of parental consent, we take reasonable steps to remove that information from our servers.

Governing Law and Jurisdiction.

This Privacy Policy shall be construed and governed under the laws of the United States and the State of Tennessee (without regard to rules governing conflicts of laws provisions). You agree that venue for all actions, arising out of or relating in any way to your use of the Site, shall be in federal or state court of competent jurisdiction located in Nashville, Tennessee, within one (1) year after the claim arises. Each party waives any objections based on forum non conveniens and waives any objection to venue of any action instituted hereunder to the extent that an action is brought in the courts identified above. Each party consents to personal jurisdiction in the courts identified above.
